These terms of service form a binding agreement between Leads4Talent LLC ("Leads4Talent", "we", "us", or "our") and the client subscribing to our services ("client", "you", or "your").

By subscribing to the services of Leads4Talent, you agree to be bound by these terms of service.


1. The service

What we provide: Leads4Talent provides subscription-based social media recruiting services. We build and manage job campaigns designed to generate applicants for your open job positions. Services are provided only while your subscription is active and paid.

Scope of service: For each job campaign, we create an entire recruitment funnel and handle media buying. This includes the creation, management, and optimization of a landing page, qualification quiz, advertising strategy, ad copy, ad creatives, ad campaign, and related systems to help generate job applicants.

Applicant dashboard & ATS: We give you access to a private dashboard to view, manage, and contact applicants. If you wish to use your own ATS, we support connections via native integrations, Zapier, Make, or email parsing only. Integrations are handled on a case-by-case basis and require your active collaboration. While basic setups are included, complex integrations may incur additional fees.

Deliverables: We deliver pre-qualified applicants (leads) for your open roles. This is a marketing service where we handle the lead generation, and you handle the hiring. We do not interview, screen, or hire candidates for you.

Campaign launch timing: New campaigns and campaign swaps are launched as soon as reasonably possible after all required information and approvals are received. Timing depends on platform reviews and client responsiveness.


2. Definitions

Job campaign: Means one recruitment funnel and ad setup, covering one job role in one hiring area. A campaign counts as active when its funnel is "live" and the URL is accessible to the public.

Hiring area: Means one labor pool, usually one city, metro area, or a defined region/territory.

Pre-qualified applicants: Means applicants who answered the application questions used in your job campaign and submitted their information. We do not independently verify applicants' identity, credentials, licenses, work history, or suitability.

Ad spend is separate: Subscription fees cover our service only. You pay all advertising costs (ad spend) directly to the ad platforms (Meta, TikTok, Google, etc.).

Failed payments: If payment fails, we typically follow this process:

You are responsible for maintaining current payment information.


4. Cancellation, termination, and refunds

Cancel anytime: You may cancel at any time. To prevent the next monthly renewal, you must notify us via email at least 24 hours before the 1st of the upcoming month.

When your subscription ends:

No pausing: We do not offer a subscription "pause" option. You must either maintain your subscription or cancel and resubscribe later.

Upon cancellation:

Our right to terminate: We have the same right to cancel at any time. We may also end the service immediately if you breach these terms, engage in abusive or seriously uncooperative behavior toward us, or if your business or advertising activity puts our platform accounts or reputation at risk.

No refunds: Because we begin work immediately upon subscription, subscription fees are generally non-refundable except where required by law. This includes partial months or unused time, platform restrictions or technical issues, early cancellation, dissatisfaction with results, and change of mind. We may, at our sole discretion, offer a courtesy adjustment or partial refund where we believe it is fair and appropriate, but we are not required to do so.


5. Third-party platforms & restrictions

Third-party platforms: We rely on advertising platforms like Meta (Facebook/Instagram), TikTok, Google, and others. These platforms occasionally apply automated reviews, restrictions, outages, or policy changes, which may delay campaign launches or performance.

Not our responsibility: We are not responsible for:

Active support & billing: We actively assist in resolving platform restriction issues through account reviews, verification guidance, policy compliance adjustments, and coordination with platform support. Some cases require your timely cooperation (such as providing business documents or completing account verification). Platform restrictions or technical issues do not pause billing and do not qualify for refunds, as troubleshooting and technical support are part of the service. However, if a platform issue materially affects campaign delivery for an extended period, we will work with you in good faith to find a reasonable solution.


6. Data & intellectual property

Your data: You own all applicant data collected through your campaigns.

Data processing: To the extent we process personal data on your behalf, we act as a data processor and you remain the data controller. We process personal data in accordance with applicable data protection laws, including GDPR where applicable. Our data processing agreement (DPA) applies and is incorporated by reference into these terms: tos.leads4talent.com/dpa

Your accounts: Campaigns run on your Meta Business Manager, ad accounts, pixels, Facebook pages, and other business accounts where applicable. You retain full ownership and control of these accounts at all times.

Our materials and methods: We retain ownership of our underlying templates, systems, processes, campaign structures, strategy, know-how, reusable materials, and funnel frameworks.

Campaign materials: During your active paid subscription, you may use materials we create for your campaigns, including ad copy, creatives, landing pages, and qualification flows. After cancellation, continued use requires our written permission, unless otherwise agreed.


7. No guarantees

Leads4Talent is a marketing service provider, not a traditional recruitment agency or staffing firm.

We do NOT guarantee:

Why: Results depend on multiple factors outside our control: your job offer competitiveness, local market conditions, how quickly you contact applicants, your interview process, workplace culture, and ad platform performance. We control the marketing. You control the hiring.


8. Client responsibilities

To achieve strong results, you must:

9. Communication policy

Email-first communication: We keep communication simple, fast, and practical. Our main communication channel is email. This helps both sides keep a clear written record of decisions, feedback, approvals, and next steps. We are available when something needs to be discussed. If a call is useful, we will schedule one. But our default way of working is email-first.

What to expect:

Working style: If you require frequent meetings or daily phone contact as part of the service, we may not be the right fit.


10. Liability & indemnification

Our liability to you: We are not liable for any indirect, consequential, or incidental damages, lost profits, or missed opportunities arising from your use of our services, except in cases of our gross negligence or willful misconduct. If we are found liable for any claim, our total liability is limited to the most recent monthly subscription payment.

Your indemnification to us: You agree to defend, indemnify, and hold us and our officers, employees, contractors, and subprocessors harmless from third-party claims, damages, and legal expenses arising from your breach of these terms, your violation of applicable laws, or your processing of personal data.


11. General provisions

Independent contractor: We are an independent contractor, not your employee, partner, or agent.

Entire agreement: These terms constitute the entire agreement between you and Leads4Talent, unless we agree otherwise in writing.

Modifications to terms: We may update these terms from time to time and will notify active clients of material changes via email. Continued use of the service after changes take effect means you accept the updated terms.

Governing law: These terms are governed by the laws of the state of Florida. Any dispute will be handled in courts located in Florida.
